On September 3, 2009, the USEPA released an updated table that lists more than 200 chemicals that are or have been subject to final Toxic Substances Control Act (TSCA) Section 4 test rules and/or enforceable consent agreements (ECAs) issued by the USEPA under the TSCA Existing Chemicals Testing Program. The table, which is identified as the “Sunset Dates of Chemicals Subject to Final TSCA Section 4 and Related 12(b) Actions, Modified on September 1, 2009,” provides the following information:
· Each chemical compound in ascending Chemical Abstract Service (CAS) Registry number order.
· The Federal Register (FR) and Code of Federal Regulations (CFR) citations.
· Sunset date/status for export notification requirements.
USEPA states that subject chemical substances or mixtures will remain in the table for historical as well as information purposes, even when those chemical substances or mixtures have sunset and TSCA Section 4 final test rules and enforceable consent agreements/orders are no longer applicable. Finally, the USEPA states that it plans to use the expanded information in the table to revise and update that table that is currently found at 40 CFR 799.18.
