On April 6, 2010, the US EPA proposed to add sixteen chemicals to the list of toxic chemicals subject to reporting under section 313 (TRI) of the Emergency Planning and Community Right-to-Know Act (EPCRA) of 1986 and section 6607 of the Pollution Prevention Act of 1990 (PPA)[FR April 6, 2010 17333]. These chemicals have been classified by the National Toxicology Program (NTP) in their 11th Report on Carcinogens (RoC) as “reasonably anticipated to be a human carcinogen.”
EPA believes that these sixteen chemicals meet the EPCRA section 313(d)(2)(B) criteria because they can reasonably be anticipated to cause cancer in humans. EPA adopted a production volume screen for the development of this proposed rule to screen out those chemicals for which no reports are expected to be submitted. Based on a review of the available production and use information, these sixteen chemicals are expected to be manufactured, processed, or otherwise used in quantities that would exceed the EPCRA section 313 reporting threshold.
The National Toxicology Program (NTP) is an interagency program within the Department of Health and Human Services (DHHS) headquartered at the National Institute of Environmental Health Sciences (NIEHS) of the National Institutes of Health (NIH). The mission of the NTP is to evaluate chemicals of public health concern by developing and applying tools of modern toxicology and molecular biology. Polycyclic Aromatic Compounds category is consider a persistent, bioaccumulative, and toxic chemical and therefore have a lower reporting threshold of 100 pounds.
EPA estimates that 175 facilities will be affected by this proposed rule. These 175 facilities are expected to file 186 reports containing release and waste management data for the 16 chemicals being proposed for addition.
Comments on the proposed additions to the toxic chemicals list subject to EPCRA section 313 must be received on or before June 7, 2010.
